It is Ordered and Notice is given that on February 19 , 2026 at 9:30 AM, a hearing will be held in this Court at Blue Earth County Justice Center, 401 Carver Road, Mankato, Minnesota 56001, on a petition for the adjudication of intestacy and determination of Decedent’s heirs, and for the appointment of Rachel M. McMahon, whose address is 120 Dane Street, Mankato, MN 56001, as personal representative of the Decedent’s estate in an unsupervised administration.
Any objections to the petition must be raised at the hearing or filed with the Court prior to the hearing. If the petition is proper and no objections are filed or raised, the personal representative will be appointed with the full power to administer the Decedent’s estate, including the power to collect all assets; to pay all legal debts, claims, taxes, and expenses; to sell real and personal property; and to do all necessary acts for the Decedent’s estate.
Notice is further given that, subject to Minn. Stat. § 524.3-801, all creditors having claims against the Decedent’s estate are required to present the claims to the personal representative or to the Court within four (4) months after the date of this notice or the claims will be barred.

CHAPTER 96
PRIVATE USE OF CITY BOULEVARDS AND UNOPENED RIGHTS-OF-WAY
§ 96.01 DEFINITIONS.
For the purpose of this Chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
BOULEVARD. That area within the public right-of-way, located between the back of the street curb and the nearest lot line of privately-owned land.
UNOPENED RIGHT-OF-WAY. Any area in which the City has an easement for a street or alley right-of-way, but that the City has not opened to public travel.
§ 96.02 MAINTENANCE RESPONSIBILITY.
A private property owner is responsible for maintenance of the boulevard or unopened right-of-way directly abutting the owner’s property. Such maintenance includes, but is not limited to, mowing grass, watering, removing weeds and maintenance of trees.
§ 96.03 PRIVATE USE OF BOULEVARDS.
Within a boulevard, nothing shall be erected, placed, planted, or allowed to grow except the following:
(A) Grasses, flowers, and/or similar vegetation (non-noxious varieties only);
(B) Trees existing as of the effective date of this Chapter;
(C) Excavations for installation of essential services, driveways, and curb cuts (or related improvements) authorized under this Code;
(D) Those features authorized under 96.06; and
(E) Those improvements erected, placed, or planted within the boulevard by, or under contract with, or with, or with, or consent of:
(1) The City;
(2) Blue Earth County along County-owned roads; or
(3) The Minnesota Department of Transportation along State-owned roads.
§ 96.04 PRIVATE USE OF AN UNOPENED RIGHT-OF-WAY.
Within an unopened right-of-way, nothing shall be erected, placed, or installed except for private improvements as authorized by § 96.05. Any such use by a private property owner authorized by § 96.05 is limited by, and subordinate to, the use of the right-of-way by the City or other persons authorized.
§ 96.05 CERTAIN PRIVATE IMPROVEMENTS.
(A) Private improvement. The City realizes that in certain instances, a private property owner may wish to erect, place, or plant certain private improvements within the boulevard or unopened right-of-way abutting the owner’s land. Such improvements include, but are not limited to, ornamental fences, hedges, berms, sidewalks, driveways, pavement, planters, statues, irrigation systems, rock, and landscaping (hereinafter “private improvement”). Private improvements shall not include any permanent features such as a concrete foundation or other feature requiring major removal efforts.
(B) Permit required. No person shall erect, place, or plant any private improvement within a boulevard or unopened right of way abutting their private property without first obtaining a permit from the Public Works Supervisor. In addition, any existing feature which does not hold a valid permit shall require a permit at the time of any reconstruction or repair, or earlier if required by the City. If this abutting boulevard is owned by Blue Earth County or the Minesota Department of Transportation, a permit may also be required by such jurisdiction.
(C) Application and fee. A person requesting a permit under this Chapter shall submit an application on forms provided by the City, together with the fee established by Council. The application shall be accompanied with scale drawings of the boulevard or unopened right-of-way and the proposed private improvement, as well as a written description of the materials and construction methods to be used.
(D) Review of application; appeal.
(1) The public works supervisor may deny any application if the public works supervisor determines that the private improvement would cause, or could cause in the future, any inconvenience to the public. In review of an application, public works supervisor considers factors including, but not limited to, the following:
(a) Effect of the private improvement on snow plowing and snow storage;
(b) Effect of the private improvement on public safety, including traffic visibility and pedestrian safety;
(c) Effect of the private improvement on public land and public or private utilities; and (d) The public necessity and utility of the private improvement and the availability of alternate locations for the private improvement.
(2) To appeal the denial of a permit application, the aggrieved applicant must submit a written request for hearing to the City Administrator within seven days following receipt of the decision of denial.
(E) Permit revocation. The City reserves the right to revoke any permit at any time and for any reason. If the permit is revoked, the property owner has 60 days to remove the private improvement.
(F) Maintenance of private improvement. The abutting landowner shall be responsible for the maintenance of any private improvement located within the boulevard or unopened right-of-way. Any unmaintained private improvements shall be deemed to be a nuisance. The City may exercise any remedies or rights it has at law or in equity, including, but not limited to, abating the nuisance or taking possession of the facilities and restoring the right-of-way to a useable condition.
(G) Damage to or by private improvement. The City shall not assume any responsibility, and the abutting landowner shall assume all responsibility for any damage caused to or by any private improvement located within the boulevard or unopened right-of-way.
(H) Removal requirement. Any private improvement not holding a valid permit is deemed to be a public nuisance and is subject to abatement according to Chapter 94 of this Code. The City may bill the property owner for the cost of abatement or assess the abatement against the abutting property in accordance with M.S. Ch. 429, or other applicable law.
(I) Conditions. A person requesting a permit under this Chapter must:
(1) Accept all of the terms of this section;
(2) Commence and complete the private improvement within the time specified in the application; and
(3) Make such private improvement at the person’s sole expense without any expense of any kind to the City.
§ 96.06 PROHIBITED OBSTRUCTIONS.
(A) View obstruction. No tree or herbaceous plant or shrub shall be planted or allowed to grow as to obstruct the view or passage of any vehicular traffic on streets, pathways, or alleyways or pedestrians on pathways and sidewalks.
(B) Utilities. No tree, herbaceous plant or shrub may be planted under or within 10 lateral feet of any overhead utility wire or over or within 10 lateral feet of any underground public or private utility line or cable of any sort.
§ 96.07 TRIMMING OF TREES. Private property trees must be trimmed so as not to cause a hazard to persons or property or abutting property. All trees shall be pruned to sufficient height to allow free passage to pedestrian and vehicle traffic 9 feet above sidewalks and 16 feet above streets.
§ 96.08 AREAS NOT APPLICABLE.
(A) The removal of trees on public easements/rights-of-way conducted by or on behalf of Federal, State, County or Municipal or other governmental agency in pursuance of its lawful activities or functions in construction of improvements.
(B) The removal of any tree by a public utility when such tree has a reasonable potential of endangering the facilities or operations of a utility.
§ 96.09 EMERGENCIES. In case of emergencies involving natural weather events and disasters, the requirements of this Chapter may be waived by the Mayor, or in the absence of the Mayor, the Acting Mayor.
§ 96.10 PENALTIES. Any violation of the provision of this Chapter shall be a misdemeanor offense, punishable by 90 days in jail, a $1,000.00 fine, or both.

The City may exercise any remedies or rights it has at law or in equity, including, but not limited to, abating the nuisance or taking possession of the facilities and restoring the right-of-way to a useable condition.
(G) Damage to or by private improvement. The City shall not assume any responsibility, and the abutting landowner shall assume all responsibility for any damage caused to or by any private improvement located within the boulevard or unopened right-of-way.
(H) Removal requirement. Any private improvement not holding a valid permit is deemed to be a public nuisance and is subject to abatement according to Chapter 94 of this Code. The City may bill the property owner for the cost of abatement or assess the abatement against the abutting property in accordance with M.S. Ch. 429, or other applicable law.
(I) Conditions. A person requesting a permit under this Chapter must:
(1) Accept all of the terms of this section;
(2) Commence and complete the private improvement within the time specified in the application; and
(3) Make such private improvement at the person’s sole expense without any expense of any kind to the City.
§ 96.06 PROHIBITED OBSTRUCTIONS.
(A) View obstruction. No tree or herbaceous plant or shrub shall be planted or allowed to grow as to obstruct the view or passage of any vehicular traffic on streets, pathways, or alleyways or pedestrians on pathways and sidewalks.
(B) Utilities. No tree, herbaceous plant or shrub may be planted under or within 10 lateral feet of any overhead utility wire or over or within 10 lateral feet of any underground public or private utility line or cable of any sort.
§ 96.07 TRIMMING OF TREES. Private property trees must be trimmed so as not to cause a hazard to persons or property or abutting property. All trees shall be pruned to sufficient height to allow free passage to pedestrian and vehicle traffic 9 feet above sidewalks and 16 feet above streets.
§ 96.08 AREAS NOT APPLICABLE.
(A) The removal of trees on public easements/rights-of-way conducted by or on behalf of Federal, State, County or Municipal or other governmental agency in pursuance of its lawful activities or functions in construction of improvements.
(B) The removal of any tree by a public utility when such tree has a reasonable potential of endangering the facilities or operations of a utility.
§ 96.09 EMERGENCIES. In case of emergencies involving natural weather events and disasters, the requirements of this Chapter may be waived by the Mayor, or in the absence of the Mayor, the Acting Mayor.
§ 96.10 PENALTIES. Any violation of the provision of this Chapter shall be a misdemeanor offense, punishable by 90 days in jail, a $1,000.00 fine, or both.
