City of Good Thunder Ordinance No. 25-03

Notice is hereby given that the City Council of the City of Good Thunder, Minnesota, at its regular meeting held on Monday, July 14, 2025, adopted the following ordinances:
Ordinance No. 25-03: Public Nuisance Regulation in Good Thunder, MN
This ordinance addresses the regulation of public nuisances within the City of Good Thunder, Minnesota, establishing specific provisions to prevent and control nuisances affecting health, safety, morals, peace, and property values.
Key Provisions:
1. Public Nuisance Prohibition: It is unlawful to maintain or allow conditions that unreasonably affect the public’s health, safety, comfort, or peace. Examples include hazardous obstructions in public pathways or water bodies, or conditions declared a nuisance by law.
2. Health-Related Nuisances: Includes accumulation of decayed food, stagnant water, diseased animals, pollution of water sources, and unclean privy vaults or garbage cans. Noxious weeds and dense smoke are also considered health nuisances.
3. Morals and Decency: Activities like illegal gambling, prostitution, or illegal alcohol sales, as well as places promoting immorality, are prohibited.
4. Peace and Safety: Nuisances like unremoved snow or ice on sidewalks, obstructing views of intersections, excessive noise (e.g., loud parties or machinery), and dangerous street obstructions are addressed. Specific limits on noise from construction or vehicles are also set.
5. Noise Violations: Loud noises that disturb others' peace or property are prohibited, and there are hourly restrictions on the operation of domestic equipment, refuse hauling, and construction. Noise impact statements may be required for zoning changes or permits related to noise generation.
6. Nuisance Parking and Storage: Prohibits the outside storage of non-residential vehicles or materials on residential property, limits vehicle storage to four vehicles per dwelling, and sets guidelines for the appearance and maintenance
of these areas.
7. Inoperable Vehicles: It is unlawful to park, store, or abandon inoperable or partially dismantled vehicles unless kept out of view in a building or behind privacy fencing.
8. City Officers' Powers: City officials are empowered to inspect properties and enforce this ordinance. They may take action to prevent or abate nuisances, except in emergency situations requiring a warrant.
9. Abatement Procedure: If a nuisance is identified, officials must notify the property owner and occupant in writing and provide a time frame for abatement.
If the nuisance is not resolved, the City Council may order enforcement actions.
10. Cost Recovery: Property owners are responsible for the costs incurred by the city in abating nuisances. Unpaid costs may be assessed against the property.
11. Penalties: If convicted, violators of the ordinance face fines up to $1,000 or imprisonment for up to 90 days, in addition to prosecution costs.
12. Severability: If any part of the ordinance is found invalid, the rest remains effective.
13. Effective Date: The ordinance becomes effective upon publication, as required by law.
